TOTALMEDIASOURCE.COM provides web page hosting, marketing, and development. TOTALMEDIASOURCE.COM has certain legal and ethical responsibilities in relation to the use of its server and the equipment employed in bringing clients these services.

TOTALMEDIASOURCE.COM general policy is to act as a provider of client Internet presence. TOTALMEDIASOURCE.COM’s ethical principles regarding the use of its computers are detailed below. TOTALMEDIASOURCE.COM reserves the right to suspend or cancel a customer's access to any or all services provided by TOTALMEDIASOURCE.COM when we decide that the account has been used inappropriately.

Use Policies

Any attempt to undermine or cause harm to a customer of, or a server used by TOTALMEDIASOURCE.COM is strictly prohibited.

>> Unauthorized use of other people's accounts or computers

TOTALMEDIASOURCE.COM will strongly react to any use or attempted unauthorized use of an Internet account or computer. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc. Any unauthorized use of accounts or computers by a TOTALMEDIASOURCE.COM customer, whether or not the attacked account or computer belongs to TOTALMEDIASOURCE.COM, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the nature and severity of the attack.

Total Media Source will manage, update and create all client web sites on Total Media Source servers. By restricting access in this way, we are able to offer a much higher security to all of our clients media.

TOTALMEDIASOURCE.COM'S customers are privileged to be offered unlimited traffic. Unlimited traffic applies to standard web documents. Extra bandwidth usages based on back office needs may encounter additional fees. Please contact your personal sales representative.

>> To maintain the integrity of our service the following limitations apply:

TOTALMEDIASOURCE.COM will be the sole arbiter as to what constitutes a violation of this provision Commercial Advertisements with E-mail
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and E-mail. If you are found to have spammed, we will contact you to resolve the situation. If it is a severe case then we will immediately, without warning, disable your domain until the situation is resolved. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund.

>> Payment Policies

All accounts are set up on a prepay basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. Billing cycles are every three months, paid in advance. All pricing is guaranteed for the term of prepayment. PAYMENTS NOT RECEIVED 10 DAYS BEFORE EACH THREE-MONTH BILLING CYCLE BEGINS WILL RECEIVE AN ADDITIONAL $35+/MONTH LATE FEE IN ADDITION TO THE AGREED HOSTING FEE. The customer is responsible for all money owed on the account from the time the account is established to the time that the customer requests, in writing, that TOTALMEDIASOURCE.COM terminate the account and all services. All payment is in US currency.

>> Cancellation

TOTALMEDIASOURCE.COM reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and paid to the client by TOTALMEDIASOURCE.COM if TOTALMEDIASOURCE.COM institutes its right of cancellation. Any violations of TOTALMEDIASOURCE.COM policies that result in extra costs will be billed to the customer.

If a client chooses to discontinue service, please notify TOTALMEDIASOURCE.COM 30 days in advance by email to terminate services. Additional fees may apply.

>> Lawful Purpose

TOTALMEDIASOURCE.COM reserves the right to refuse service to anyone. Customers may use TOTALMEDIASOURCE.COM servers only for lawful purposes. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. TOTALMEDIASOURCE.COM expressly forbids anyone from using TOTALMEDIASOURCE.COM servers for the propagation, distribution, housing, processing, storing, or other handling of in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. Definition and categorization
of material in accordance with the foregoing description of “objectionable” is left entirely to the discretion of the TOTALMEDIASOURCE.COM management. In addition, any site selling or promoting bulk e-mail services is prohibited from using TOTALMEDIASOURCE.COM servers.

>> Indemnification

The customer/customers agrees/agree that he/she/they shall defend, indemnify, save and hold TOTALMEDIASOURCE.COM (TOTAL MEDIA SOURCE) harmless from and any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against TOTALMEDIASOURCE.COM, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer/customers agrees/agree to defend, indemnify and hold harmless TOTALMEDIASOURCE.COM against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with TOTALMEDIASOURCE.COM's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from TOTALMEDIASOURCE.COM's server.

>> Disclaimer

TOTALMEDIASOURCE.COM will not be responsible for any damages your business may suffer. TOTALMEDIASOURCE.COM makes no warranties of any kind, expressed or implied for services we provide. TOTALMEDIASOURCE.COM disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong deliveries, and any and all service interruptions caused by TOTALMEDIASOURCE.COM and its employees. TOTALMEDIASOURCE.COM reserves the right to revise its policies at any time.

Failure to follow any term or condition will be grounds for immediate account deactivation.
